If you are conducting an active business, likely the answer is both. If you are looking to get the S-Corp taxation for your business, you will first set up an LLC. Then you will elect for the IRS to treat your LLC as an S-Corp. Traditional S-Corps are rare but also have a use if you plan to take your business public eventually.

For most situations, the answer is both. Getting a Revocable Living Trust that also includes a Pour-Over Will and Advanced Directive is what we recommend for most clients. Some states have specific laws that would lead us not to use the Revocable Living Trust though so contact an attorney before you take any action here.
